HUSKEE WARRANTY POLICY

This Warranty Policy is between Huskee Pty Ltd (ACN 617 862 763) (Huskee, we, our or us) and you, the individual or entity who purchased products from us (you or your).

WARRANTY AGAINST DEFECTS

In Australia, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Warranty Period:

All Huskee products are warranted to be free of defects in material and workmanship for one year following purchase for domestic use (Warranty). We provide this Warranty to you in addition to any rights or remedies you have under the Australian Consumer Law or any other applicable law (Consumer Law Rights) and your Consumer Law Rights may extend beyond this Warranty period.

Claiming under the Warranty:

Within one year after the purchase of the Huskee products from us, if you have received a product that is unusable or faulty, or you otherwise believe is subject to a defect, you must:

• cease using the product;
• contact us as soon as you become aware that the products are defective or do not meet the consumer guarantees under the Australian Consumer Law;
• complete our claim form and supply your order number from your original confirmation e-mail, as well as a description of the damage or defect, along with an image that clearly depicts the fault and any other information reasonably requested by us (Claim); and
• pack the item(s) securely in the original product packaging, if possible. Please include all paperwork, parts, and accessories.

Where you return products to us to seek an Australian Consumer Law remedy, you will need to cover any associated costs (for example delivery costs) of you returning the products to us. Huskee is not responsible for risk in the products during shipment from the customer to Huskee.

What will we do if you make a successful Claim under our Warranty?:

A Huskee customer care representative will be in touch with you within 72 hours of receiving your Claim.

Where your Claim is a valid claim under the Australian Consumer Law, we will, at our own cost:

• repair or replace the product (the decision of whether to repair or replace is at our sole discretion); or
• if we are unable to repair or replace the product, we will offer you a choice of a credit, refund or compensation as applicable to the Defect.

Damage covered by our Warranty:

• cease using the product;
• Workmanship issues
• Material issues
• Defective products

Damage not covered by our Warranty:

• cease using the product;
• Normal Wear & Tear
• Misuse and improper care of Huskee products
• Cleaning-related issues
• Failure on your part to follow any instructions or guidelines;
• Continued use of the products after a defect has become apartment;
• Failure to notify us of any defect in the products within a reasonable time or being aware of it;
• Acts of God or force majeure events (including but not limited to war, riot, invasion, act of terrorism, contamination, earthquake, flood, fire, or other natural disaster, or any other event or circumstance beyond our control).

Further conditions to our Warranty:

Subject to your rights under the Australian Consumer Law, our Warranty is subject to the following conditions:

If you purchase our products for commercial use (including for use in offices, restaurants/hospitality, hotels, events-use): You will not be entitled to a remedy after 3 months of purchase and you agree that our BuyBack Program applies after this period.

If you purchase our products for café use: You will not be entitled to a remedy after 6 months of purchase and you agree that our BuyBack Program applies after this period.

BuyBack Program means the program whereby we may repurchase certain Huskee cups from you at a determined rate, as further specified in writing to you.
